This program has two main streams: a standard business sponsorship and a labour agreement. In a standard business sponsorship, the sponsor must meet several criteria. The most important is that the business is lawfully operating in Australia. For example, you must advertise for a job opening and pay a salary rate at least as high as the local Australian rate. You must also comply with DOHA obligations and ensure your sponsorship is used correctly. These requirements are designed to protect overseas workers from exploitation and ensure the use of the program is appropriate for your business. Applicants can live and work permanently in Australia, although they must meet specific qualifications. This visa is intended for highly skilled employees, including tradespersons. An approved Australian employer must nominate applicants. In addition, applicants must demonstrate that they have worked for the same employer for at least three years. Applicants can apply under the Direct Entry Stream or through labour agreements. They may also be eligible for the Temporary Residence Transition stream. Applicants under 45 with at least two years of continuous work experience qualify for the Temporary Residence Transition Stream. The RSMS is not available in Brisbane, Melbourne, or Perth. It is available in regional Australia. However, applicants must begin employment in regional Australia after obtaining the visa. To be eligible for the RSMS, applicants must have previously worked in Australia on a work visa. They must have an English language level that is functional.
